Data Protection Policies
1) PREAMBLE
Adsearch is a recruitment consultancy specialising in the placement of expert, executive and managerial profiles on permanent (CDI) and fixed-term (CDD) contracts, temporary assignments, freelancing, interim management and IT service provision. Adsearch is a brand of the Adéquat Group.
In the course of its activities, Adsearch collects and processes personal data relating to users of its website, candidates, and representatives of its clients and prospects, acting as the data controller within the meaning of Article 5 of the Swiss Federal Act on Data Protection of 25 September 2020 (FADP) and its implementing Ordinance of 31 August 2022, which entered into force on 1 September 2023. The purpose of this document is to present Adsearch’s personal data processing policy.
The Data Protection Policy (hereinafter the “Policy”) aims to inform you of the rights and freedoms you may exercise in relation to our use of your personal data and describes the measures we implement to protect it.
2) IDENTITY AND CONTACT DETAILS OF THE DATA CONTROLLER
Adsearch is the “data controller” for personal data relating to the management of the website and data relating to its employees and candidates. These processing activities are carried out in accordance with applicable law.
Adsearch is a simplified joint-stock company (SAS), registered with the Paris Trade and Companies Register under number 833 816 978, with its registered office at 63 boulevard Haussmann, 75008 Paris, France, represented by Mr Arnaud Brun in his capacity as Managing Director.
3) CONTACT DETAILS OF THE DATA PROTECTION OFFICER

The Adsearch DPO is shared at Group level within the Adéquat Group.
4) SCOPE OF THE POLICY
Adsearch collects personal data and uses it within the framework of various automated processing activities.
This Policy applies to all personal data processing as defined by the General Data Protection Regulation (“GDPR”) of 27 April 2016 relating to the protection of natural persons with regard to the processing of personal data and the free movement of such data.
Under Article 5(a) and (b) of the FADP, personal data means all information relating to an identified or identifiable natural person, and the data subject is the natural person whose personal data are processed.
A person is identifiable when they can be identified directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, or an online identifier. Under Article 5(d) of the FADP, processing means any operation relating to personal data, regardless of the means and procedures used, including collection, recording, storage, use, modification, disclosure, archiving, deletion or destruction of data.
Websites of the Adsearch Group operated in other jurisdictions are subject to separate policies, accessible from each respective site.
5) PURPOSES, LEGAL BASIS AND RETENTION PERIODS
The purpose of processing refers to the objective pursued, namely the need it addresses for the data controller.
By using the website, you may provide us with personal data, including information relating to your identity, personal or professional contact details, and economic and financial information.
Each personal data processing activity carried out by Adsearch is based on a specific legal basis.
Your personal data will not be further processed in a manner incompatible with the purposes described in this policy or in data collection forms.
At the end of the retention periods described below, your personal data will be deleted, except where we are legally required to retain it or where it is necessary to safeguard your rights. In such cases, data will be archived for an additional period as specified below, after which it will be deleted.

6) SHARING OF PERSONAL DATA
To achieve the purposes described above, personal data collected by Adsearch may be shared, in whole or in part, with the following recipients:
- Any company within the Adéquat Group
- Our clients acting as employers or potential recruiters
- Recruitment intermediaries, including job boards (LinkedIn, Indeed, Hellowork, etc.)
- Your former employers and educational institutions
- Potential third-party service providers with whom Adsearch works
We do not authorise third-party service providers to use your personal data for their own purposes. They are only permitted to process your data in accordance with our instructions and this Policy.
7) INTERNATIONAL DATA TRANSFERS
In the course of the purposes described in §5, some of your data may be transferred outside Switzerland. In accordance with Articles 16 and 17 of the revised FADP, Adsearch ensures that any such transfer benefits from an adequate level of protection.
Adsearch regularly transfers personal data to France and more broadly to EU/EEA Member States, including:
- The Adéquat Group and group entities acting as processors for shared functions
- Technical service providers located in the EU (hosting, software providers, consent management tools)
- Client employers located in the EU to whom applications are submitted (acting as separate data controllers)
The EU/EEA is recognised as providing an adequate level of protection; therefore, no additional safeguards are required under Article 16(2) FADP.
8) SECURITY AND CONFIDENTIALITY
Adsearch implements appropriate technical and organisational measures in accordance with Articles 8 FADP and 1–6 OPDo to prevent personal data from being altered, damaged, or accessed by unauthorised third parties.
9) DATA BREACH NOTIFICATION
In the event of a personal data breach likely to result in a high risk to the personality or fundamental rights of data subjects, Adsearch will notify the Federal Data Protection and Information Commissioner (FDPIC) without undue delay, in accordance with Article 24 FADP. Affected individuals will also be informed where necessary or if required by the FDPIC.
10) RIGHTS OF DATA SUBJECTS
Right of access
You may obtain confirmation of whether your data is being processed and access it.
Right to rectification
You may request correction or completion of inaccurate or incomplete data.
Right to erasure
You may request deletion of your personal data, subject to legal exceptions.
Right to restriction of processing
You may request limitation of processing of your data.
Right to object
You may object to processing based on legitimate interest, including direct marketing.
Right to data portability
You may request your data in a commonly used electronic format or its transfer to another controller.
Right to withdraw consent
Consent may be withdrawn at any time without affecting prior processing.
Right to lodge a complaint
You may file a complaint with the FDPIC (Feldeggweg 1, 3003 Bern, Switzerland) or via www.edoeb.admin.ch.

12) POLICY UPDATES
Adsearch may modify this Policy at any time, particularly to reflect legal, regulatory or technical changes. Significant changes will be communicated appropriately (website notice or email) before they take effect.
